South Africa: WADA Update on Compliance Status of the South African NADO

As a follow-up to the Executive Committee (ExCo) meeting of the World Anti-Doping Agency (WADA) on September 22, 2023, and the update from September 28, 2023.

WADA wishes to provide additional stakeholders with information regarding the ExCo’s decision to support the independent Compliance Review Committee (CRC) recommendation and claim that the National Anti-Doping Organization (NADO) of South Africa violates the World Anti-Doping Code (Code).

South Africa’s laws did not follow the 2021 Code, which led to the non-compliance in this case.

The NADO had 21 days after receiving the formal notice of non-compliance under Article 9.3.1 of the International Standard for Code Compliance by Signatories (ISCCS) to contest WADA’s claim of non-compliance, as well as the consequences and the reinstatement requirements put forth by the Agency.

The South African NADO formally notified WADA today that it disagrees with the accusations of non-compliance made against it and the suggested penalties.

WADA will soon forward the issue to the Court of Arbitration for Sport (CAS) for review. As a result, the accusation of non-compliance is suspended, and the repercussions won’t take effect until the CAS rules.
